1. Nature of Service

The Pips Project (the Platform, we, us, or our) is a software-as-a-service data analytics, trade journaling, and performance tracking tool. The Platform is designed to help users log, organize, analyze, and review their own trading activity. The Pips Project is not a registered investment advisor, broker-dealer, financial planner, commodity trading advisor, or any other form of regulated financial services provider in any jurisdiction.

2. No Financial Advice

Nothing on the Platform - including but not limited to trade analytics, playbook metrics, Monte Carlo simulations, confluence engine outputs, blueprint projections, risk desk calculations, or any other data visualization or computational output - constitutes financial advice, investment advice, trading advice, or any other form of professional advice. All metrics, charts, statistics, and projections displayed on the Platform are derived solely from data that the user has inputted or synced and are presented for informational and educational purposes only.

Any decisions you make in the financial markets are made entirely at your own discretion and risk. You should consult with a qualified and licensed financial advisor before making any investment or trading decisions.

3. No Guarantee of Results

Past performance data recorded, displayed, or analyzed within the Platform does not guarantee future results. Historical trade data, win rates, expectancy calculations, equity curves, and all other backward-looking metrics are records of past activity and must not be interpreted as predictive indicators of future trading performance. Markets are inherently uncertain and past results are not indicative of future performance.

4. Hold Harmless & Limitation of Liability

By using the Platform, you expressly agree to hold harmless and release The Pips Project, its founders, officers, directors, employees, agents, affiliates, and licensors from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Any trading losses, including but not limited to losses of capital in personal, funded, or prop firm trading accounts;
• Any decisions made based on data, metrics, analytics, or outputs displayed on the Platform;
• Any failure to pass or maintain a funded trading account evaluation, challenge, or assessment;
• Any reliance on playbook statistics, strategy performance metrics, or Monte Carlo simulation outputs as if they were financial recommendations;
• Any disruption, downtime, data loss, or inaccuracy in the Platform or its third-party integrations.

Under no circumstances shall The Pips Project be liable to you or any third party for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

5. Assumption of Risk

Trading forex, CFDs, commodities, equities, indices, and cryptocurrencies carries a high level of risk and may not be suitable for all investors. You should be aware of all the risks associated with trading and seek advice from an independent financial advisor if you have any doubts. By using the Platform, you acknowledge and accept that you are solely responsible for your trading decisions and their financial outcomes.

6. Third-Party Integrations

The Platform may integrate with third-party services including but not limited to MetaTrader 5, MetaAPI, TradingView, and Supabase. We do not control, endorse, or assume responsibility for the accuracy, reliability, availability, or security of any third-party service. Any use of third-party integrations is at your own risk.

7. Regulatory Notice

The Pips Project is not registered with, licensed by, or affiliated with any financial regulatory authority including but not limited to the SEC, CFTC, FCA, ASIC, or any other regulatory body. The Platform does not facilitate, execute, clear, or settle any financial transactions whatsoever.
